These terms govern your use of the Kaizen Systems website and the services we provide. By using this website or engaging us for work, you agree to these terms. Please read them carefully. If you do not agree, please do not use the website or our services.

Our services

Kaizen Systems provides website design and development, CRM setup, automation and related digital growth services for businesses. The specific scope, deliverables and timelines for any engagement are set out in a written proposal, quote or agreement.

Quotes, proposals and scope

• Quotes and proposals are estimates based on the information provided at the time.
• Work outside the agreed scope may be quoted separately.
• Any change to the agreed scope should be confirmed in writing.

Fees and payment

Fees are set out in your proposal or invoice. Unless otherwise agreed in writing, a deposit may be required before work begins, and the balance is payable on the schedule stated in your proposal. Invoices are payable within the period stated on the invoice.

Your responsibilities

To help us deliver on time, you agree to:

• Provide the content, access and information we reasonably need
• Respond to requests for feedback and approvals in a timely way
• Ensure that any material you provide does not infringe third-party rights
• Keep any credentials we issue to you secure

Intellectual property

We retain ownership of our pre-existing tools, methods and code. Upon full payment, we assign or licence to you the specific deliverables agreed in your proposal, as set out there. You retain ownership of your own content and brand materials.

Confidentiality

We treat the information you share with us as confidential and use it only to provide and support the services you have engaged us for. Our obligations under the Protection of Personal Information Act (POPIA) are described in our Privacy Policy.

Limitation of liability

To the maximum extent permitted by law, Kaizen Systems is not liable for indirect, incidental or consequential loss, or for loss of profits or data, arising from your use of this website or our services. Our total liability for any claim is limited to the fees you have paid for the specific service giving rise to the claim.

Termination

Either party may end an engagement in line with the terms of the relevant agreement. You may stop using this website at any time. Any provisions that by their nature should survive termination (such as payment, intellectual property and limitation of liability) will do so.

Refunds and cancellation

For cancellation requests, treatment of unused project fees, ongoing service renewals and refund processing, read our Refund and Cancellation Policy, effective 31 October 2026. Applicable statutory rights take precedence.

Governing law

These terms are governed by the laws of the Republic of South Africa, and any dispute is subject to the jurisdiction of the South African courts.

Changes to these terms

We may update these terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Continued use of the website after changes are posted constitutes acceptance of the updated terms.
